The answer is simple: read the previous lease carefully. If a lease is well-written, it will spell out the exact terms as to what happens when the rental agreement expires.
Many times, unless clear notice is given by either party to change the terms of the original rental agreement, a lease either will be renewed automatically at the same terms or it may turn into a “month-to-month” contract.
If the lease is poorly written and no mention is made as to what occurs at the end of the rental term, then the tenant cannot be held to the terms of an expired lease.
But again, you’ll have to read the original lease document to determine this.
