The decision as to which type of Deed a person should use to transfer property to another depends upon the type of guarantee the person making the transfer wishes to provide.
A Warranty Deed serves to transfer property and contains certain “warranties” (or promises) made by the seller or grantor concerning the condition of the title to the real property.
A Quitclaim Deed serves to transfer property but does NOT contain any “warranties” (or promises) by the seller or grantor concerning the condition of the title to the real property.
Either deed can be used to transfer property to or from a Living Trust, and both are included in Standard Legal’s Quitclaim Deeds legal forms software title.
