The signed Separation Agreement should address specifically the disposition of any personal property from a marital home.
But if a spouse is not willingly removing personal belongings from the marital home after repeated requests to do so, short-term there may be little a divorcing spouse can do to compel the action.
Once the Divorce decree is finalized by the Court and the terms of the Separation Agreement are incorporated into that Divorce Decree, the matter changes. However, it may be wise to send a certified letter to the divorced spouse to set a final deadline for the removal of personal property.
Until that time, caution would be urged on the premature disposition of such property…
